Terms and Conditions of Eskape Holidays (The Small Print) 1. The Contract A contract is formed between you and Eskape Cottage (Claire Brown-Frame & Eric Waterworth) referred to as “we” or “us”) for the provision of short-term holiday rental of our cottage when we send you confirmation of your booking. We reserve the right to refuse booking prior to confirmation of the booking. We will provide such short-term rental subject to these terms and conditions of booking. Your statutory rights are not affected by anything contained in these terms and conditions. No employee or representative of us has the authority to vary these terms and conditions. 2.The Cottage We aim to ensure that the information on the website is accurate; however, there may be small differences between the actual property and its description. Where, due to unforeseen circumstances the property in question becomes unavailable, we reserve the right to cancel your booking. Under these circumstances we would give a full refund. 3. Price We reserve the right to increase or decrease the price shown in the price list at any time. However, the price on confirmation of the booking will not be increased unless the booking is amended. 4. Payments To book this cottage a £100.00 deposit will be required. The balance of the total price must be paid one calendar month before your stay. For any booking less than one month prior to the start of the rental period you must pay the full price when booking. In the event of late payment, we reserve the right to cancel the booking, and keep the deposit. 5. Cancellation If you have to cancel your holiday cottage you must let us know as soon as possible. On receipt of such notice we will use reasonable endeavours to re-let the cottage. If we are successful we will refund you your money (or part if we are only able to re-let the cottage for part of your rental period) less our administration costs. If we are not able to re-let the cottage, you will be liable to pay 100% of the total price. 6. Your Obligations You and all guests must take good care of the cottage and its contents and leave them in the same condition as they were in on your arrival. You will be liable for the cost of any damages, breakages, losses and any extra cleaning or repair costs, which are incurred, due to your non-compliance with this condition. Only the number of people detailed on our booking confirmation will be entitled to occupy the cottage. Please respect the other residents in the area, as a lot of properties are occupied permanently. You will be able to have access to your cottage at 2pm on the first day of your rental period and you must vacate the property by 10.00am on the last day of your rental period. 7. Dogs You should check with us to confirm if you are allowed to take your dog. A £100.00 deposit is required. This will be refunded after your stay, once the cottage has been inspected, to the satisfaction of Claire or Eric (not the cleaner). If you are taking a dog, you must keep it under control at all times and on a lead when in communal areas. Please clean any mess up from the streets and do not allow your dog to foul the areas around the cottage i.e. the yards front and back. Please confine your dog to the kitchen/dining room of the cottage. A deduction will be made from the refund of the deposit, if there is any excess dog hair or mess. 8. Complaints If you have any cause for complaint you shall bring this to the attention of Claire or Eric to allow them an opportunity to achieve a satisfactory solution. In any event you should formally register your complaint at the time. On your return from holiday you should write to us within 14 days of your return detailing your complaint. We cannot consider any complaints where you have not complied with the above conditions. 9. Rights of Entry We reserve the right to enter the cottage at reasonable times to inspect the cottage and/or carry out any necessary repairs or maintenance. 10. Liability We do not exclude our liability for death or personal injury caused by our negligence. Except as stated in above clause, we shall not be liable for: a) any loss or damage caused directly or indirectly by circumstances or events beyond our control; b) any indirect or consequential losses; c) any lost profit or other business losses. Our total liability for any tangible damage to your property caused by our negligence will not exceed £10,000. Our liability other than in respect of those detailed in Conditions 9a and 9b will be limited to the amount you paid us for the hire of the cottage. 11. Law The contract between you and us is subject to English law.
